DEA has proposed exempting chemical mixtures containing GBL from regulatory controls under the Controlled Substances Act. The proposed rule is expected to provide comprehensive regulatory relief for the industry.
DEA’s proposal addresses three areas: domestic distributions, industrial distributions, and exports. Industrial distributions are defined as large-scale shipments, including tank truck shipments, that are 4,000 kilograms or more. A single segmented compartment is not considered a regulated transaction if the weight of GBL in each container is less than 4,000 kilograms.
A person is prohibited from possessing GBL if they have been convicted of trafficking methamphetamine. GBL has been documented as a precursor in clandestine synthesis of GHB. DEA has not identified any other chemical that has replaced GBL in clandestine synthesis of GHB.
DEA is implementing a rule to eliminate large-scale industrial distributions without significant risk of diversion. The regulation is intended to eliminate clandestine operations that can divert self-contained shipments of 55-gallons or less. It is also expected to reduce the risk of diversion and provide more comprehensive regulatory relief for the industry.
SS 90-101 provides a list of activities that are prohibited under the Controlled Substances Act. A person must register and pay a fee for engaging in these activities. Registrants must maintain inventory records in G.S. 90-104. They also must provide effective controls to prevent theft. If a person is convicted of a drug offense, the licensing board may suspend or revoke his or her license to engage in those activities.
DEA is unaware of any United States firm that will have to register
Despite having spent millions of dollars on GBL research, the Drug Enforcement Administration (DEA) has yet to identify any United States firm that actually handles GBL. While the DEA is aware of retailers in the United States that sell chemical mixtures containing GBL, there are no retailers who are actually importing, distributing, or manufacturing GBL. For this reason, the agency has opted for the formal approach, requiring registration from any entity that produces, imports, or exports GBL, whether or not they are domiciled in the U.S.
To make the rule more palatable, DEA has proposed a feasibly priced one-time registration fee for GBL importers, distributors, and manufacturers. The fee would represent approximately 0.1 percent of a wholesaler’s sales, a pittance compared to the cost of importing GBL into the U.S. In addition, DEA is proposing a one-time small business tax credit to stimulate manufacturing and manufacturing-related employment. This is a boon to small firms, and a boon to consumers as well.
The DEA has not yet decided whether or not it will be imposing any new requirements on its existing registrants. The agency has been in touch with retailers that have sold GBL to determine if they have any plans to reformulate their products. In the meantime, a handful of retailers have made the bold move of taking their products off the shelves in the name of science.
